To Carry On The Business Of Manufacturers Companies in Malaysia

The Companies Act 2016 lays down the general framework for the registration and regulation of companies in Malaysia. Under the Companies Act 2016, a company may be registered as a private company, public company, or foreign company. A private company is defined as a company which by its articles of association:

(a) restricts the right to transfer its shares;

(b) limits the number of its members to fifty; and

(c) prohibits any invitation to the public to subscribe for any shares in, or debentures of, the company or to deposit money with the company.

A public company is defined as a company which is not a private company. A foreign company is defined as a company which is incorporated outside Malaysia and which establishes a place of business in Malaysia.

The Companies Commission of Malaysia (SSM) is the statutory body responsible for the registration of companies in Malaysia.
